DEED TO WILLIAM SMITH, SON OF RICHARD SMITH, DECEASED 28 NOV 1836 AS PART OF EXECUTION OF WILL.  Transcribed by J.B. Francis

 William Smith.

             This indenture made and entered into this 12^th day of December, 1836, between the undersigned heirs and widow of Richard Smith, deceased, of the one part, and William Smith of the other part, all of the county of Perry and state of Kentucky.  Witnesseth: that for and in consideration of the sum of $200., the undersigned heirs and widow of Richard Smith, deceased, hath this day granted, bargained and sold unto the said William Smith all the right, title, claim and interest that they may hold of to, concerning a certain tract or parcel of land, containing 50 acres, situate, lying and being in the county of Perry and state of Kentucky, on waters of Lott’s Creek, a branch of the North Fork of the Kentucky River, and bounded as follows, to wit: Beginning on three beeches, sugar tree and sycamore on the bank of the Big Fork of said creek, 4 poles from its mouth; N 34 West 24 poles to a beech; thence N 62 W 2 poles to a gum, sugar tree, and beech; thence N 81 W100 poles to a beech; thence N 42 W 220 poles to two beeches; thence N 55 W 100 poles to a stake; thence S 30 W 20 poles to a stake, thence S 48 E 105 poles to a stake, thence east 20 poles to the beginning.  To have and to hold the above tract or parcel of land from the undersigned and their heirs forever; and to the said William Smith and his heirs forever.  Given under our hands and seals the day and date above written.

Commonwealth of Kentucky, Perry county, to wit:

                        I, Jesse Combs, Clerk of the County Court for the county aforesaid, do certify that this deed of conveyance from the heirs of Richard Smith, deceased, and his widow, Elisha Smith, to William Smith, was this day produced to me in my office and acknowledged by Lorenzo D. Smith; Samuel Smith and Lisha Smith on the 12^th day of December, 1836, to be their acts and deeds for the purpose therein mentioned, and was also proven to be the act and deed of the said Joshua Smith, John Campbell, Zachariah Fugate; Thomas Smith, James Smith, Isaac Smith; George Combs, Thomas Grigsby, Nicholas Smith, Martin Fugate, by the oaths of John Grigsby and William Grigsby on the 14^th day of June, 1847, and acknowledged by John Stacy and wife, Cinthy Stacy and Kizey Grigsby on the 24^th day of September, 1847 to be their act and deed, and acknowledged by Nancy Smith on the 28^th day of March, 1848, to be her act and deed; and the said Kizey Grigsby, Mary Fugate, Nancy Smith and Cinthy Stacy being examined by me privily and apart from their said husbands, declared that they did freely and willingly seal and deliver the said writing, again shown and explained to them to be their act and deed and conseateth that the same may be recorded, whereupon, the said deed together with this certificate, hath been duly admitted to record in my office.  Given under my hand this 28^th day of March, 1848.                                                          Jesse Combs, Clk.
