Present: Francis Browning, Ezekiel Burdine, Benjamin Johnson & Amos Smith,
Gents.
An Indenture of Bargain & Sale from Joseph Hammon and Sarah his wife to Joseph Kiser was proved by the oaths of Joseph Kiser, Jesse Fullen, & Mac Kiser the witnesses thereto,& Ordered to be recorded.
An Indenture of Bargain & Sale from William James and Ann his wife to Thomas James was acknowledged in court by the said Wm. James & Ordered to be recorded.
James Browning, George Robinson, Michael Hinson, Monsieur Leforce, Jacob Lambert, Henry Childs, James Hindricks, Robert McReynolds, David Muncey, Stephen Grose, James Pendleton, WM. Necesary, James Lee, Dale Carter, Isiah Salyers, Jacob Castle, Jacob Kinder, Drury Price, John Porter, were sworn as a Grand Jury of inquest for the body of this county and having received their charge withdrew and after sometime returned into Court and presented several Surveyors of roads for neglect of duty-----William Newman, John Elliott and Lewis Henry for committing breaches of the peace. John Wood, Richard Bennett, George Roberts and Nelson White for drunkenness. Nathaniel Hooper, Nelson White and Jesse Morton for profane swearing. George Gibson and George Vaught for reselling spirituous liquors contrary to law and having nothing further to present was discharged.
Ordered that John Wood, Richard Bennett, George Roberts, Nathaniel Hooper, Jesse Moreton, and the several surveyors of roads this day presented by the Grand Jury be summons to appear here at the next term to answer the said presentments; and that those presented for breaches of the peace, and for retailing spirituous liquors contrary to law be summoned to appear at the same time to show cause why informations should not be filed against them.
On the motion of Ann & Joseph McFarlane who made oath and together with James McFarlane and Nathan Hobbs their securities entered into and acknowledged a bond in the penalty of one thousand dollars, conditions as the law directs, certificate is granted the said Ann & Joseph McFarlane for obtaining letters of administration of the estate of Robert McFarlane decd. in due form.
Joseph Tate and William Price------who were summoned to attend this court this day as Grand Jurymen were solemnly called but came not. Therefore it is considered by the court that for their said contempt they severally make their fine with his Excellency James Barboun, Esq. Governor or Chief Magistrate of this Commonwealth and his successors by the payment of eight dollars each; to the use of the said Commonwealth unless they show sufficient cause of their inability to attend at this or the next court.
Samuel Duff vs. John Gibson Security facia On the motion of the defendant by his attorney and it appearing to the court that security was required for the payment to the defendant of such costs and damages as might be awarded him; and such security not being given with the clerk of this court, it is ordered that the suit be dismissed, and that the plaintiff pay to the defendant his cost.
Zackary Fugate surviving adm. of John Williams decd vs. David Hamilton, Nathan Hamilton and Jesse Corum In debt Nicholas Honaker and Martin Knifong (?), special bail for debts Nathan Hamilton & Jesse Corum.
Peter Halcup vs. Jesse Corum In debt Nathan Hamilton special bail.
